Dental Implant Cases

When a dental implant case turns on whether the standard of care was met, both plaintiff and defense counsel need an expert who has actually planned, placed, and restored implants — not just reviewed them on paper. Dr. Sam Morhaim, DDS, FICOI, brings over 30 years of clinical implant and periodontal surgery experience to case review, written reports, depositions, and trial testimony nationwide, representing plaintiffs and defendants alike.

Professional clinical background

An Independent, Evidence-Based Review — For Either Side

Dr. Morhaim is retained by both plaintiff's attorneys and defense counsel in dental implant litigation. His opinion follows the clinical evidence — the records, imaging, and applicable standard of care — regardless of which side has engaged him. That independence is often what makes an expert's testimony credible to a judge or jury in the first place, and it's reflected in his case history on both sides of implant disputes.

Whether you're evaluating a potential claim or defending a treating dentist, Dr. Morhaim can tell you early, candidly, and confidentially what the records actually support.

Dental Implant Case Types Reviewed

Dr. Morhaim reviews the full range of dental implant disputes, for either plaintiff or defense counsel, including:

  • Failed or failing implants — early or late implant failure, osseointegration failure, and peri-implantitis
  • Nerve injury and paresthesia — claims involving inferior alveolar or lingual nerve involvement during implant placement
  • Sinus perforation and complications — implants placed in the maxillary posterior and related sinus evaluation questions
  • Implant positioning disputes — questions of angulation, overload, or restorability
  • Full arch and full-mouth reconstruction disputes — All-on-4/All-on-6 and full-arch case outcomes
  • Informed consent issues — disputes over what risks, alternatives, or techniques were disclosed and documented
  • Corrective and revision surgery cases — disputes over the necessity, execution, or cost of implant removal and replacement
  • Bone grafting and site development complications — graft outcomes and pre-implant site preparation

What a Dental Implant Case Review Includes

Every engagement is scoped around the specific questions the case requires answered, for whichever side has retained him:

  1. Records review — clinical notes, radiographs (periapical, panoramic, and CBCT where available), treatment plans, informed consent documentation, and lab records
  2. Standard of care analysis — whether the treating dentist's diagnosis, planning, and execution met the applicable standard of care at the time of treatment
  3. Causation assessment — whether the alleged injury or outcome was caused by a deviation from the standard of care, versus a known and disclosed risk of the procedure
  4. Written expert report — a clear, well-organized report suitable for disclosure, written in language a non-dental audience (judge, jury, opposing counsel) can follow
  5. Deposition testimony — available for deposition as a retained expert
  6. Trial testimony — courtroom testimony that translates clinical detail into a credible, understandable narrative for a jury

Why Attorneys on Both Sides Retain Dr. Morhaim

  • Hands-on surgical experience. Dr. Morhaim has personally planned and placed dental implants throughout his career, including complex full-arch and bone-grafted cases — not just reviewed them from the outside.
  • Periodontal specialty training. Advanced training in periodontics and oral biology (Boston University), directly relevant to implant site development, peri-implant disease, and soft-tissue complications.
  • Leadership credibility. Former Director of Periodontics at Flushing Hospital Medical Center.
  • Florida licensure. Licensed to practice dentistry in Florida, alongside his New York clinical practice.
  • Recognized standing. Featured in New York Magazine (2024) and a Newsday Professional Achievement Award recipient; ICOI Diplomate.
  • Consistent, independent standard. Applies the same clinical standard whether reviewing a claim on behalf of a patient or defending a treating dentist's care.
  • Responsive to case timelines. Direct communication with retaining counsel and prompt turnaround on records review and reports.
